I am sure the developers did though, and if I was aware of it, there was no way that I would have bought it, instead we would have bought the other one in the same estate, that we were looking at. When you got the land contract it would have had a contour survey in it.... and you would have seen this before signing the contract. Did you check the contract and check the contour survey? Did you have a solicitor/conveyancer check over it? Check it again.... if it doesn't show a ditch on the survey you have a good argument to have the developer fill in and flatten for you. But if it does show it on the contour survey... then sorry but you signed it and there's nothing you can do. There will be a survey in your contract.... I'm almost certain it's a legal requirement.
