Browse Forums Building A New House 1 Dec 22, 2023 9:30 am My next door neighbour is currently in the process of constructing a new house. The problem is that they’re planning to build a garage on the boundary of our lands. The proposed garage will block all of our sunlight, particularly in the living domain, which includes a long dining room window, and a kitchen door.
From the wall to the boundary, it is 2.5 metres. The front street adjacent fence is 8.5 metres. After the neighbour builds the garage, it will be 6.5 metres in length and 2.7 metres tall. Is there any advice you can give me? Re: Building Inquiry 2Dec 23, 2023 12:15 pm Building permit is subject to satisfying overlooking and shadowing provisions of the building regulations res code. From what you have posted you will still be getting substantial sunlight because of 2.5 M distance It requires calculations based on the orientation and height of your window sill from the floor. One dining room window is 2.1 metres in height and a kitchen window is 1 metre in height. As well, is there any further advice you can give me? Re: Building Inquiry 5Dec 27, 2023 3:05 pm Thank you for your response. The council isn’t listening to my concerns. If anyone is wondering, the garage built on our boundary will be 6.5 metres in length. This will not only block sunlight to my kitchen and dining room, but also to my other rooms.
Re: Building Inquiry 7Dec 27, 2023 6:48 pm What are the design rules for Victoria? I’m not sure about it. Re: Building Inquiry 9Dec 27, 2023 11:24 pm Thank you for your response. The building surveyor who drew out the plan mapped out the garage for 2.7 metres in height and 6.5 metres in length, when in reality, they marked it for 7.5m on ground in length when I measured it. Is there any advice you can give me? I’m also wondering if the garage would also be more than the height that’s mapped out on the plan. As for when I read the regulations myself, I get very confused. I don’t know much about the rules. Is there anyone I can get to help me with this as well?
