I have contacted 1 in the past and they didn't return my email for about 2 months, so when they did respond I thought - I don't think I can go with you, you take too long to reply!! And I was recommended another but they are actually based in Melbourne and I am in Brisbane, so they didn't want to take it on. No issue yet - other than being unsure if we should use a construction lawyer to review a building contract and suggest additions/removal of clauses before we sign. I don’t know if many people do this but I’ve been told by a couple of sales consultants that it’s not common to use a lawyer at this stage as they add too many unnecessary and restrictive clauses into the contract and then no builder wants to do the job. Not sure if that is just their experience and genuine good-will advice or a way to get us to not have a ‘difficult’ contract to deal with… but yeah. Not sure if a lawyer is generally only used in residential builds when issues arise or also/just as a precaution to protect the consumer/client at the very start…. You will not have any success in having any of your own clauses put into the contract. Builders have developed their contracts in a way that suits them and any change requests will be met with a "take it or leave it" response. The purpose of having the contracts reviewed is primarily to alert you to any clauses that may be worth your consideration/concern, not so you can lobby a change to them. The most important section of standard industry type lump sum building contract is special conditions. This is where the builder or the owner have opportunity to insert clauses for their benefit. Builders special conditions should be critically examined and re negotiated if required. As a potential customer you have the power to walk away, and do so if builders terms are onerous. Once you sign the contract you are bound. So for example if you want to bring your own contractor say for data cabling(I don’t recommend) that should be in special conditions, or better still You can get your contractor to become builders nominated contractor, that way builder is in control and builders responsibility.
