They are pointing me to Clause 8 in my contract. However, Schedule 1 -Item 6A Security Account (Clause 8 ) is answered as NO. So does Clause 8 apply in this case? And did you or anyone you know face this issue with the builder? If in doubt find a contract lawyer pretty quickly because your builder may try other trickery in the future. Be prepared. Is the builder nervous because they think you may not pay for the variations? So AFAIk the outcomes of the BAL ratings form part of a clause that allows them to pass these costs on to you.
