Messy demo- Soil removal

Im doing a KDR in Sydney and engaged a demo company recommended by the builder. The builder wants to start the excavation process and has come back to me saying that there are broken roof tiles, waste etc from the demolition.
"Based on this, we would not be able to remove the soil as it is not clean fill. It would be considered Contaminated Soil". The solution is that we can:

Ask your demolition company to remove the top layer to ensure clean fill

Or

We credit you the soil removal aspect of your home and you can arrange soil removal through the demolition company

Or

We would have to quote based on the material removed as it comes out.

I have a provision in my tender for soil removal- would this be the same if I go with their second option? The demo company isn't budging either

What does the site actually look like? How deep is the contamination and how big is the site? You could estimate the volume of soil pretty easily and call around to get an understanding of what it would take to get this excavated and dumped.

The builder will want to dump the soil at a clean fill site no doubt.

The demolition company likely have their money and have moved on.

Not an enjoyable situation to be in.
