No communication, but whenever I initiate - it's BS....or threats of shutting down my build for calling too much! Covid/weather aside...this build should have progressed much further. Product left onsite for weeks. Weeks without any activity at all. Site super/tradies have quit...from the start, deceit and avoidance have been the tools of trade with Hudson. 40week contract...pffft! Are we alone here? Mate, you are lucky in that they have build something for you. I went with Hudson Homes, paid the initial deposit, then went through the variations and signed the final contract, paid the 5% deposit (over $25k), and within a couple of months they came back to ask for another $85k. All this within the fixed price contract period. They stopped answering emails, no response to documents submitted, and now have said they will not construct our house. And now they have walked away with our $25k deposit. Absolutely awful. I will never recommend anyone to go with Hudson Homes. All our dreams shattered. Our hard earned money is gone. They have pocketed all our hard earned money. That is their business. He then offered to substantially reduce the variation for you as a gesture of goodwill even though your fixed price tender had expired. The increased costs and time delays over the past 18 months have been very real and as much as we’d like to carry 100% of these costs, many builders are finding themselves in a position where they simply cannot. You have mentioned that you have taken this to Fair Trading. We are, as we have explained to you, happy to abide by whatever ruling they give. We understand that you are frustrated and that you would like to use this medium to publicly voice your opinion, however the comments you are making are not complete and nor are they fair. The contract clearly says "the contract price stated in this contract shall remain fixed up to and including the Tender Expiry Date stipulated in the Tender Document included within this Contract, being 29/06/2022 (“the Fixed Price Guarantee Date”). So the tender fixed price expires on 29/06/2022. The demand for the extra $85k was on 26/05/2022. This is more than a month before the expiry of the fixed price tender. The company workers and the CEO do no even know what comes first: 26 May or 29 June. No wonder there are so many problems. And then they are prepared to openly lie about this. Anyone wants to see the contract and verify the dates, just let me know and I am willing to email that to you or put it up here for everyone to see. Facts are facts. The least they should do is refund less costs incurred. No way their costs are $25k without any construction started. I'll be sure to avoid this builder. LKumar, for complete clarity, the letter was sent to you on the date it became evident that your construction would not be able to commence prior to your tender expiry date. It was designed to give us ample time to resolve the pricing issue with you without unnecessarily further delaying progress. Also, at no stage did we ever state we are keeping your full deposit. We understand that you are disappointed with the price increase and it seems that we will not be able to come to a fair agreement to renew your contract. Upon termination, your deposit, less costs incurred, will be refunded to you. Our office will be in touch with you regarding this. Anyone built this plan before? Would be great to chat about it.
