Browse Forums Building A New House 1 Oct 24, 2008 1:05 pm Just wanting advice on the following: "The home to the right hand side is setback 6.5m and the home to the left hand side is set back 11.6m, by Rescode we have to be a minimum of the average between the two, which is 9m." The thing is that the house on the left is actually a corner block with their right side fence being next to us. So they are actually setback from the street adjacent to us. The 11.6m has been taken from our street to the side of their house not the front. Having a 9m setback reduces our backyard by nearly 3m! Plus it will mean our house will be significantly setback more than all other houses in our street. Which are all basically have the same setback of 6.5m. What do you think the chances are of getting it changed to 6.5m to match the rest of the street? Is there anything else I could do. I have tried to contact council and builder and waiting their response. Has anyone else been in a similar situation? What was the outcome? To my mind your setback would be 6.5 met. Having said that interpretations can vary, so clarification from the relevant building surveyor would be prudent. Thanks for the reply. I have heard back from builder and they are waiting on surveyor. Seem to think it should be ok so just waiting for confirmation that 6.5m is ok. House will look out of whack being setback further from the rest of the houses. Plus who want more frontyard than backyard? Thanks again. Even though council agrees that house on corner should be ignored it still needs dispensation. This will cost $205 and will take a couple weeks. Oh well just a money making exercise.
I guess if you are in this situation tell your builder before they do the site survey to ignore the corner. Just a pain and another expense to deal with. Will also have to get consent from neighbour??? Re: Setback when next to corner block 6Nov 08, 2008 4:45 pm We're building in Sutherland (Sydney) in a similar situation. Our northern neighbour is on the corner and faces the other street, but unlike your situation, their east side setback from our street is smaller than "normal".
The rule in Sutherland is for a 7m setback, but they will consider requests to vary that. Right at the beginning of the planning stage, we asked our builder Clarendon how we could overcome the council rule so that our setback could be reduced to something more like our neighbours which was closer to 5m. We didn't even consider the north neighbour with only about 2m setback - perhaps it would have made a difference if it had been 7m. The builder's rep, who was an experienced chap, suggested we put together a case to submit to the council along with the DA. So we took photos of the adjacent 2 or 3 property setbacks and pleaded that 6m would be a good compromise. Another argument we used was that complying with a 7m setback would seriously reduce our private space at the back of the house - our block is trapezoidal with only a 10m rear boundary. Council say that it can take up to 3 weeks and that we have supplied them with quite a bit of information. They will send out a surveyor and advise us ASAP.
