Browse Forums Building A New House 1 Apr 24, 2022 9:04 pm I am new to the forum - my husband found it after searching for reviews of Tribeca / Birdy Homes. We signed a fixed house and land package with Birdy in September 2021. The land registration was going to take a 18 months to register, so we settled on a design they said was specific to the lot and a 'higher fixed' price for an 'architectural design home' and because the land wasn't registered. A month ago they sent us a price variation of $81k valid for only 6 months, 7 months into the contract - reserving the right to revise this after 6 months. Their correspondence referenced the pandemic and building cost increases and that we had 7 days to sign an annexure to the contract or they will take further 'legal action according to the contract. When I questioned under what clause and the fact that our HIA contract did not have a Rise and Fall Clause, they told us they will come back to us with appropriate response by week of 25 April 2022. So far they have refused to give us a breakdown value of prime and provisional cost items or any allowances as required under the contract. I have logged a complaint with NSW Fair Trade but they cannot enforce the contract. At this stage I want to walk away form this full turn key build, with them refunding my deposit and we do our own custom build. We have provisionally priced homes with various builders this month and we can add a second story and an average of 80-100sqm for the same price. I am terribly disappointed with their customer service, which is a centre email address and not even a contact person with a number. We onto our second contract manager in 7 months and we haven't even registered land which is on track but according to them is taking longer than anticipated. If anyone is in similar situation with this builder, please share your experience. We are very anxious to move forward with them. We not disputing that building prices have gone up (in fact my husband works in the civils industry) but the way they went about it and for a 230m2 single storey they wanting us to pay $625k and I think its too much, especially if I don't know what my inclusions are or made facade choices. Hey buildoak60 Welcome to the forum You have paid well over the $ticker price (humour) I doubt the builder will let you off the hook (there's still probable siteworks and engineering increases to come)... That's what builders call "money for jam", while their contract has locked you in. As for fake artist renderings/impressions... they aren't worth squat OT Always wise to own your own design, engineering, data/proofs and estimates. You're not the only one in this position. They have sent these price variations to many customers like you. They claim that they have all rights reserved under the contract so they can vary the price whenever they want and if you don't agree with it then you can cancel the contract but they will not return your deposit in full. This is a deliberate tactic they use to either make you pay the additional price or forfeit most of your deposit. I'm not sure about NSW but in Victoria they've been trying to claim price variation under Clause 23 of the HIA contract, which has nothing to do with the price but only building works. We had to hire a lawyer to speak to them after which they backed down and said they will do it for the original price. The land was settled in February this year and since they keep making excuses for why are not getting building permits. They are either trying to punish their customers who didn't accept the price increase or they are trading insolvent and can't build these houses anymore.
