Here we are at almost 18 months, and the build definitely won't be starting in time. This is completely out of our hands, both the fault of council and the builder causing endless delays. Was wondering if anyone has heard if they might be extending to 30 months or if we might be able to fight for an extension? Also, as this was a fixed contract we signed, the builder has offered to pay us out of the contract with 20k... should this be something we consider if we miss out on the grant? We have been tearing our hair out with the delays and the development (road etc) hasn't even been completed. Hope this all makes sense... Re: Home builder grant 3May 20, 2022 10:00 am if the contract was signed in Dec 2020 it will most likely be a loss for the builder, if they were to build right now (and you'd have to pay way more to build the same house with a different builder). That's probably why they are trying to pay you out. I'd try and get some quotes to see how much your exact spec would cost to build right now before making any decisions. While I personally hate speaking to anyone on the phone, it's the only surefire way to get an answer... everything else is just hearsay! As an aside, very sorry to hear about your current situation. Unfortunately, covid has changed the building industry so much that I'm not sure how we'll ever get back on track. Some of the delays I've been hearing about are astounding! Hi jezzarose You may want to refer to your contract to enforce your rights, and if the builder makes a claim for extension of time based on delay, then that should be assessed accordingly. You may be entitled to damages, but you will need to refer to your contract or otherwise, perhaps, in common law. It may also be a good idea to seek the advice of a specialist construction lawyer in your area, who can help you make an informed decision on whether to opt out of the contract, or to take the matter to CBS and eventually South Australian Administrative and Civil Tribunal (SACAT).
