You're not the only one in this position. They have sent these price variations to many customers like you. They claim that they have all rights reserved under the contract so they can vary the price whenever they want and if you don't agree with it then you can cancel the contract but they will not return your deposit in full. This is a deliberate tactic they use to either make you pay the additional price or forfeit most of your deposit. I'm not sure about NSW but in Victoria they've been trying to claim price variation under Clause 23 of the HIA contract, which has nothing to do with the price but only building works. We had to hire a lawyer to speak to them after which they backed down and said they will do it for the original price. The land was settled in February this year and since they keep making excuses for why are not getting building permits. They are either trying to punish their customers who didn't accept the price increase or they are trading insolvent and can't build these houses anymore.
