Apparently there are 'implied' easements on land that does not appear on titles.
**warning for new home buyers** s32 doesn't tell u everything about the land.
Be very wary of the term 'Implied Easements', yes they do sometimes do exist in places/subdivisions, but they don't necessarily give your neighbour the right to construct across your property, nor do they definately affect/burden your particular piece of land. I would definately get legal advice from a Solicitor and/or Licensed/Registered Surveyor, that is pertinent to your parcel.
If this is an estate subdivision I would do my damdest to find out the Engineering Company who did the design, and ask the general question 'what provisons did you make so that my neighbours property has a legal point of discharge'. If it is an estate the surveyors should be listed on the Plan of Subdivision and they should be able to tell you who the Engineer is/was.
