Browse Forums Building A New House 1 Feb 18, 2022 7:09 pm Hi guys, can anyone recommend a reputable Sydney based private building inspector (with current builders licence or experiance) to help oversee the house constructuction across all phases to call out issues and non compliance build practices? Basically, after a company that knows all the building regulations and standards, who can highlight defects once we start building. This way, I have a leg to stand on if things go wrong. When I starting working with him he was based on the Northern Beaches but moved down to the Southern Highlands, I think he travels up here a couple fo times a week. Be aware if you are using the standard HIA contract the builder is under no obligation to even read your inspectors report, let alone fix the identified defects during your build. Hovever you are obliged to make the progress payments irrespective of defects. Almost every defect in the early stages can be termed "incomplete works to be adressed later, i promise" BS (ie when 95% or all of your money has been paid!) or simply covered up by the builder. Better to inspect and know the issues, but be prepared to negotiate hard with the builder to get them to agree to fix, then follow up dillengently to ensure whats promised is actually done and done correctly. Your circa $2k stage inspecting report set is just the start of this process and the rest will be up to you. You are completely correct, however there are still legal remedies available under the HIA contract but it means putting the builder into breach of contract, and you have to be willing to essentially go nuclear and walk away mid build if the builder refuses to rectify But I am not giving legal advice. For this you need a really good construction lawyer who will fight to the death for you. This is why I always try to tell people to not sign an HIA contract. They are so one sided in the builders favour and as a consumer the decks are really stacked against you. Honestly, a builder who only uses the HIA contract in NSW and refuses to even look at the NSW Fair Trading contract needs to be a major red flag. And that is my Monday morning rant!
