The lot next to us will shortly commence construction and are building 200mm from our shared boundary (garage wall). Can this be done without gaining access to my property? The builder has stated that they will be in touch should they require access but I'm not keen on having the fence pulled down for a number of months whilst they build (for obvious security and privacy reasons). It'd obviously be tight when it comes to laying bricks, right? We also paid for the cost of the entire fence as the lot has only recently changed hands from the developer (who wouldn't contribute). If the fence is colorbond it can be taken down and reinstated after without damage. Just ask them to turf/ landscape any damage and erect a temp fence for security and contribute half original cost. They might need access to make the brick joints look nice, even if they can lay them from the inside. You can ask them to rotate the part of the fence they will be pulling down towards your wall to close off the backyard. Would be also good opportunity to ask them for the 50% contribution I'll probably be in the same position as your neighbors when we finally start building, cause the houses around our lot are already going up, but our builder won't commence construction for a while. Nobody approached us about anything, so had no idea that wasn't the norm until I saw how awful the bricks looked in the gap. Whether or not they asked our landlord and they said no, I'm not sure. Our relationship with the owner is good, but I'm not sure if I want to impose putting a pole on their property.
