I would suggest no. The items would fall under minor defects, you should list them on yours and your builders PC Inspection paperwork (Both parties should sign off on it), you get to list the items of concern, the builder must then give you a timeframe on when the defects will be completed. If their not completed in the timeframe then you can lodge a complaint with the state's building authority. We are Expert Consultant's, and we are here to help. Their correct position is determined by practical compliance. Before complaining about the downpipe's position, you need to determine compliance and any adverse affect repositioning your want my have. Marin 4. Thnks These are defects that need to be listed and issued to your Builder for rectification with a notice. State the clauses under your Contract and provide a time frame for rectification. Under HIA contract you can withhold 2.5% of the final claim sum until all items are rectifed. You are paying for a house and it's the duty of the Builder to provide you with a well-finished house, defect-free. Building and Legal has given a really good response which I totally agree with, however I thought I might be able to add a little practical advice. So as Building and Legal has correctly said, Practical Completion is generally when the building is fit for purpose and habitation, unless the definition in your contract is different. ALWAYS check you contract as this term will be defined in the list of definitions. Based on your description of your list, all of these items can be fixed during your defects period. However I would do the following: 1. See if you can do a walk through with your supervisor and put these items in writing to the builder. 2. You will generally have a 3 month defect period ( again check your contract) but live in your house for a while as you will notice more defects whilst you are living there, and I guarantee new ones will show up, like soft close drawers and hinges not closing properly etc, so just keep a detailed list that you can submit at week 10 or so.
