I am seeing all this nonsense and time wasting by builders signing up new contracts that they can't honour in a reasonable period of time which has got me worried. I have yet to sign a contract going to council or hand over large amount of money. Are there any clauses that can be inserted to tighten up an existing standard HIA contract that a volume builder use? I am prepared to negotiate a higher price for tighter build time frame with bigger penalties for failing to deliver. Has anyone managed to negotiate such clauses or do volume builders work on a take it or leave it approach? This forums building expert has vast experiences with pre contract inspections and mistakes and unfair clauses are quite common,it's hard getting volume builders to stump up with penalties for late builds as there are numerous ways of getting out of penalties such as rain delays,public holidays etc which add weeks and months to their finish dates,even if their not really justified. There is a stock standard house plan that may or may not be built in 12 months. There is a stock standard house plan that will almost certainly be built in 9 months. There is a custom design with high end fittings that may or may not be built in 12 months. And there is a custom design with high end fittings that will be prioritised. And all of these are worth different amounts to the client and to the builder. Would just like to know if there are any incentive levers that can be pulled to ensure that I am not on the bottom of the builder's to do list. Sorry, what is an "OT builder"? When I questioned why they didn't get their own Builder to finish the job They said he was ripping them off on variations, so they had the items taken out ? The Builder told them to do it after handover?
