Property on the left of the photo, is mine. The right is my new neighbour. The agreement was to cut the blocks level so a center retaining wall wouldn't be needed. However the neighbour changed his plans after my cut and fill was done. Deciding to have the rear of his property at the ground level height. And as you can see the bulk of his land at his retaining wall height. I was told he would take care of the center retaining because of this change. My retaining wall was finished a month before work on his lot started. Today I received this picture from my builder. My neighbour is now saying "Because your builder has cut into the land, beyond the natural slop, they need to retain what they have altered" Which wasn't the agreement, and he made changes to the agreement, after our work was completed. Little at a loss on how to handle this. Tried contacting my builder today but couldn't get him on the phone. Office told me he'd respond by end of business, but didn't. We've already paid for the completed retaining wall, budgets tight. And with the rain in South East Queensland being non-stop. Really concerned the entire back half of my neighbours land will collapse further. Any advice on how to handle this situation? Who's in the right here? Did both builders, drop the ball here? I think that means you from your description. It sounds like they just changed their minds about wanting the cut. I wouldn’t begrudge anyone, you are getting the benefit, but of a hassle but not a huge area to build. Thank you again Simeon.. I will call my certifier for that.
