Browse Forums Building A New House 1 Dec 06, 2021 1:58 pm I'm new to this forum and building, so please forgive me if my questions are silly. We signed a building contract late August, we kept getting told by the building designer "it's best to lock in the price now due to all the increases" and "your plan should be sorted by now" after maybe half a dozen visits. It's a custom floorplan! The same week, we were introduced to someone else who wanted us to confirm the floorplan was correct, but we had changes to it, we felt pressured to getting the floorplan signed off with the building designer and ended up changing the main bathroom because we weren't happy with it. Our land registration was delayed and it was registered in October, two months after we signed the build contract. We finished our selections in October but there were two quotes that continuously responded weeks later holding things up, no matter how many times you contacted them. 3 weeks ago the builders asked to book in a pre-construction meeting (booked for tomorrow, they requested it be in three weeks time) and told me today that there would be a price increase as the 90 day commencement date had passed. They couldn't lodge any plans with council until the land had registered which wasn't until late October, settlement was mid November. What are our rights with the price increase? I feel like it was beyond our control and some of it beyond the control of the builder. I also feel like we were a bit pressured or coerced into signing the contract. I would like to be prepared tomorrow and not taken for a ride so even if the price increase is inevitable, I would like to be understanding and professional. They also mentioned they would be discussing the timeframe for the build to be complete but if they do the price increase, I would like the 270+ days to be adhered to. I've felt pretty lost, was made pretty upset by one supplier (he bad mouthed me and made me feel like I couldn't ask questions or go into store, etc.), we also haven't received paint samples, etc. like most people receive. So I've had to google paint samples and everything, I actually went and bought paint samples. We are having problems with the shed now, different builder, and completely out of their control, but if our application isn't approved it will affect our build. Sorry for rambling on, obviously I am pretty upset at this point. Re: Fixed Price Contract 2Dec 06, 2021 9:31 pm Hi Newgirl, You need to say what state you are in, building contracts are different for each state Thank you so much everyone. This all makes a lot of sense. I guess when you talk to a builder who butters up everything to look very polished, you get to start believing… 7 17615 So AFAIk the outcomes of the BAL ratings form part of a clause that allows them to pass these costs on to you. However the more relevant detail is how did it go from 19… 1 9165 You talk about deletions, are they variations or PS and PC adjustments? pleas list them 1 16568 |
