Then got this from the Council regarding driveway application. I don't want to change the location of the driveway, so 1. does it mean I can still have the driveway where it was designed on the CDC, but have to do extra things to protect the roots? If I do that is there any possibility of the council still refusing to approve the driveway location? 2. how much more will it cost to have those things required - suspended concrete and modified footings? the council cross-over is about 3 meters long and 3.4 meters wide. 3. Can I start the main house construction without the council driveway approval yet? The main house's CDC has been approved. Thank you in advance! Council's email: The proposed driveway for the CDC is offset 1.85m from councils street tree. If you would like it to remain in the proposed location, an arborists report will be required as the proposed driveway’s position is encroaching into the root structure of the tree or you may need to consider vehicular access from The Strand. Council would prefer that the driveway is located outside the TPZ but any works within the vicinity of Councils street trees will require a Tree assessment and Root Mapping report provided by a consultant Arborist (AQF5) for consideration of the applicant. Council requires the report demonstrates: tree protection measures in accordance with Australian Standard Protection of trees on development sites (AS 4970), root mapping to the depth of the proposed construction and recommendations for non-invasive construction design, including: suspended slab, and modified footings that minimise soil disturbance and subsequently root damage. Council plant street trees, which to be fair are on their property, but all too often this then restricts what you can do on your property. We have two street trees on the council property for our new house. Fortunately the new driveway was located nicely between them but well within the TPZ's. We dodged a bullet regarding root mapping but were concerned that Council specified temporary fences to protect 6m diameter TPZ's (as per AS4970) for each tree, which, taking into account the location of the trees would have left little space between the fences for access to the 15.25m wide property. Fortunately it's all a bit of a butt covering exercise for council as they required us to get an AQF5 arborist to prepare and report compliance of a more specific tree protection plan. We shopped around for a AQF5 arborist who had a practical approach to the problem (the tree protection fences specified in the AQF5's plan were 40% the size suggested by Council) and the private certifier just ticked the boxes for the plan and the compliance based on receiving paperwork from the AQF5 arborist. So, shop around for an AQF5 arborist who will help you solve the problem. Many of them spend more time chopping trees down than protecting them from development. I had to get an AQF5 arborist report which cost us $8k and a 3 month wait to obtain. The report required us to move our piers if we hit any tree roots over 50mm in diameter. It also imposed a myriad of controls including fencing around trees, not disturbing the earth around the trees etc... I also had a neighbour with a camera on me 24/7 ensuring that I was complying. We ended up having to move four piers which cost $1k in engineer costs to have the slab redesigned. I do not recommend going down this path if you can avoid it from the perspective of cost, time and emotional energy. Hope it helps. Hi, how do you resolve that? I am in whitehorse city council and we are facing the same issue. Builder put crossway extension on the drawing and the driveway enters into the SRZ and TPZ. I am thinking we should shorten the extension and avoid the SRZ before we submit the planning application Yes it had a house on it.
