That is the state complying development code... otherwise known as CDC, which I don't think applies to your development as you've mentioned that you've submitted an application for a DA (through your local council). One of the good things about CDC is that it doesn't allow for neighbour objections. We would have preferred getting our planning approval through CDC but were forced to the DA process because we had an overland flow path (which is one of a handful of things that disqualifies from using CDC). Our DA took over 6 months to obtain the approval, compared to the 2 weeks for CDC. Sounds like the DA will be assessed against the Development Control Plan, LEP and any local special considerations. 'In established areas, the character has already been defined. New development should clearly relate to the existing development pattern of the neighbourhood. For new areas, incremental development of new streets and spaces together with house designs will generate a particular character of the area over time. The character of an area is made up of a combination of factors such as type, form, bulk and height of development, building setbacks, design, landscaping, lot sizes, subdivision layout and siting of public places.' As per PCA/private certifier for CDC, inland Housing Code Clause 3D.25 which requires a window in a habitable room in the ground floor fronting the primary Ours was a double storey width is 8.5 meters where the 6m is for double garage. The remaining is front door with sidelight. The entrance is marked in the floor plan as entry/study nook. I don’t know if suck wont fit the definition of habitable room. Somehow Im a little bit confident that as per setbacks, height, it meets the requirement. The good thing about the DA process is you can submit a non-compliant application and argue the merits (but which would make you vulnerable to complaints from neighbours). For us, Rawson were very good at identifying areas of non-compliance (of which we had many, and still managed to get DA approval) so I'd expect if you had any non-compliances they would have raised them to your attention before submitting the DA. As Simeon said earlier... if your plans are compliant then don't stress as the neighbours objections shouldn't stop the DA being approved. Ans this is what I found out They hcut the eastern side of the boundary by at least 1000mm and put a 1000mm retaining wall. They constructed a 1800 colorbond fence (which we paid half of it) on top of that retaining walls. That’s a total of at least 2800mm total height.
