Browse Forums Building A New House 1 Aug 26, 2021 8:28 am If a builder of an adjoining property excavates into your property, and then pours concrete in, who should you claim damages / compensation against (the owner or the builder)? The Victorian Building Authority stated that we can get compensation through VCAT, (ie to have the concrete removed) but I am getting mixed comments on who to take to VCAT. I would prefer to deal with the owner of the property next door, as we have had extensive issues with this builder.. Re: Do I Take the Owner or Builder to VCAT for Damages to ou 2Aug 26, 2021 9:12 am If your property has been damaged or compromised then formally ask the builder to address it. In most contracts the builder controls, and is responsible for what happens on their building site. Its not the owner's doing or responsibility. As a courtesy FYI let the owner know what your asking their builder for. Also we approached one of their staff when they were on-site and was told that the issue is within our property boundaries, so we had to fix it. There has been a lot of issues with this particular builder. We have let the owner know about the above situation. I will be so happy when I see the last of the builder next door. This is the first time we have encountered so many problems with a builder. I never noticed any of the other builders, who built around us or next to us in the past, but this builder has been different. I suggest you make a statement at the local police station and go from there. Hi Mofflepop, I would recommend finding a building designer to prepare plans, they should design to your specified budget. The benefit is you can tender the project out… 9 20562 It worked for me in getting all non notified rain days removed from the builders claim, although the LDs was only $50/day 7 5971 |
