Browse Forums Building A New House 1 Jun 07, 2021 9:23 pm Hi all, I'm currently in the middle of a new build. We are only a couple on months from completion, but the lot beside us is still totally vacant, with no sign of activity yet. We are concerned, because this neighbours block allows them to build their garage on the boundary (and as its quite a small block, they would be silly not to). We knew this when we first settled, and accepted it, largely because it's in quite a sought after area, and with the grants available, all blocks in the street were under contract. We figured that we would all be built around the same time, so no issues, however unfortunately, contracts fell through, and the block has only recently been sold, several months later. We're largely questioning what we can actually do, regarding fencing, leading up to this? We obviously want to be able to secure our property, and get started on a yard, have a fence for the dog, etc. But how does this work, if building has not yet commenced, or if that particular section of their wall/garage is not completely finished/rendered/painted yet? Dont really want to have to wait months (considering the backlogs and delays in building at the moment) before we can have our property secured. Nor do we want to waste money on a fence if it will just be removed by their builders a short time later, and still leave our yard exposed during the process. Possible option of building a fence slightly into our property boundary? Has anyone else had this issue at all? We just can't seem to think of a solid solution. Located in QLD, if that helps. Although normally ppl just use garage wall in place of the fence, and start the fence where it ends. Looks better. Have you had a chat with the owners? My question is, do we just have to accept that the section of fencing where the garage is to be placed, will be removed, and not be secured for the dog, while they actually build that garage? Our build is nearing completion, whereas theirs hasn't even started yet.we want a fence up asap, but can't do that if they're using the garage as the fence? Re: New build, neighbours garage on boundary 5Jun 08, 2021 2:39 pm Our neighbours started their build about a week before ours finished. We had the same issue with the fence. We asked for a copy of their plan and had our fence built to around a metre to the back of their garage. Our fencer put up a temporary panel from the house to the fence and then when they finished, he came back and finished the fence and the landscaping down that side of the house. Yes, it was an inconvenience, however, the animals were secure in the back yard. Our build is nearing completion, whereas theirs hasn't even started yet.we want a fence up asap, but can't do that if they're using the garage as the fence? my understanding is that the owners of the lot are responsible for half the cost of the fence regardless of whether they are building anything or letting the lot sit empty. so if you want a fence up - you can get 3 quotes, present to them and agree on who to use. when they actually come to building, you can agree on how they go about the fence. whether they are going to take down part of the fence for construction, how big of a part, for how long etc. when they do, you can probably use that section to close off part of your yard temporarily. bottom line is, you really need to talk to them to understand their plans and express your concerns. also keeping in mind that you'll potentially be living next to each other for many years, so it's important to maintain a good working relationship and solve issues in a pragmatic fashion. After the build was completed we relocated the gate and mounted it closer to the front of the house I said after the 1st build “ never again “ & now im on my 3rd Re: New build, neighbours garage on boundary 9Jul 16, 2021 4:11 pm I am in similar situation, my neighbor who is about to move in want his fence all the way to front even where we will have a garage wall which could act like a fence. I offered them 200mm of our land for them to use if they agree to finish fence where our wall on boundary starts. They seem to be reluctant and want their gate 2.5m behind front wall stating that is how developer has approved the fencing. (i would have thought developer would have no objection to using boundary wall as fence) They are pushing to get fencing done in next 2 weeks as they want to move in ASAP that is understandable. So I have convinced them to request fencer to do first 3 panels along the wall on boundary to be removable panels so my builder can remove them during the slab & brick stage and then reinstate panels back where they were. Has anyone done this before? Not ideal but not worth arguing to much with new neighbors even before starting the build. I didn't bother checking their quotes, I trusted their due diligence rather than finding a better value for money quote. The person building next to my property has had no consideration to me or the laws that are attached to building on the borderline. I have received no notification saying the carport wall will be on the boundary line. I have had part of my fence taken down so the slab can be laid. i received no notification saying they would like to enter my property. I was told by the new knower that my boarder is 20cm into his land. I asked if he had survey papers and if so can i see them. He has not replied.. I was never asked if i have any pets, which I dont, But the week they took part of my fence down I had arranged with my son to look after his dog that weekend. My son cancelled his weekend away. I live by myself my property is 1555 square meters with the back of my sheds facing the new build. I had building material at the back of those shed and a small shed that has car parts stored in them, There is also pine trees that are along the fence line. All it would of took was the new neighbour to have a little bit of courtesy, a small amount of respect and things could of ran smoothly. The pine trees are old and look pretty bad I personally dislike them. Only if the new neighbour came spoke with me I would of removed the pine trees. Now he will have to deal with his gutters and pine trees. So just maybe sit back and look at whether or not you have communicated with your new neighbour. It really doesnt take to much.
