Hi, we are planning a KDR on a property and our builder is recommending a setback based on average of two homes on the left as the property on the right is a church (non-residential) and over 10m away.
Home1 on left: 16m
Home2 on left: 17m
Church on right: 11m (is 10 m away from boundary)

Question - do we have any chance to use the church on the right for calculating average setback? This will make a huge difference of 2m to our setback.
PS: we are in Kurangai council.

Our builder is saying that we can build on the same foot print as the old home. Is this correct ?
What was your out come ? We are building in Kurangai council.
Cant use the corner block as a reference. So we had to use the closest two homes which aren't corner blocks for setback.

CDC is your best chance for a less compromised outcome, but you will not be able to use the church setback - that's if CDC is even possible, more than half of Kuringai council area has a NIMBY zoning which prohibits CDC planning approval.
Council won't be any better unless perhaps it happens to be a super ugly church that the neighbours want obstructed from view. But just looking at the plan there I don't like your chances. Check the DCP - but I would say your builder is speaking the truth in this instance. Sorry not much help.

You need to look at the council guidelines for setbacks which are something like Dwelling Houses 4A Section 2 and have a read. I think you'd be able to use the church like you say and calculate the average between the two adjoining properties. The fact that one of them is a church in my opinion is irrelevant.

Sounds about right to me. I remember in 2017 one of the big builders telling me that the last time they did a KDR in Sydney less than $500k all up was around 2012....…
