Browse Forums Building A New House 1 May 10, 2021 5:25 pm Hi All We are having a house built by Burbank homes (house and land) I want to install underfloor heating in the tiled areas, Burbank doesn't do this or even put in electrical provision for it. I asked them if they would let a company to come in and fit it before laying tiles and they said no, so I said well leave it bare and their answer was they can't because of building code. Has anyone had to deal with this kind of problem and is there an answer apart from getting cheap tiling done and then ripping it up? Thanks in advance for any help. We are building in Adelaide. Hi Kenje52, My guess as to why they wont allow you to do it is that they don't want to take responsibility for the warranty if something malfunctions ie if the heating doesn't work they don't want the responsibility for ripping up the tiles to fix it. Assuming you are in NSW, here is where I think they are wrong, ( I am sure some smart person will tell me if I am wrong) but my understanding of the statutory warranties is that there is an exclusion for all items supplied by the owner. So if you were to supply the heating it is actually better for them and they could say that they are not responsible for any problem associated with it. They could even make an argument ( rightly or wrongly) that any work near the heating such as waterproofing is no longer covered by their warranty. So at the end of the day, it could actually be better for them to do it or allow your contractor to do it. I suspect that they aren't smart enough to figure it out or they just don't want the hassle. After all project home companies are just big sausage factories and they don't want anyone upsetting the production line. I was actually going to pass on the details of the GM who I know very well, but I just check his linkedIn and unfortunately he left in Oct 2020.
