Browse Forums Building A New House 1 Feb 03, 2021 4:08 pm Hi everyone, I am building a house with Carlisle Homes, and our site is about to start. They have sent me a document to sign, containing the final plans for the build. The plans were wrong, they were not the latest version, and not the plans that were approved by the council. I told them about the error, and they ackniwledged it. However they are still asking me to sign the document, saying they do not ever re-issue documents (their system doesn't allow it), and instead in the case of errors they issue variation documents afterwards. They have sent me an updated (now correct) plan to sign, but I am still not comfortable signing the document with the wrong plan. My CLE has told me that unless I sign this document, the build will not start. But if I knowingly sign something that is wrong, I feel like I'm leaving myself legally liable. Any advice? Re: Carlisle homes: Should I sign an incorrect document? 3Feb 03, 2021 4:54 pm Their Document Control procedures should allow you to simply acknowledge you've received the documents, and noted the errors. The next Rev of the documents should be the one you sign. Stating their Document Control procedures don't allow them to reissue documents is an out and out lie. How do they rev up drawings if they can't reissue them? Re: Carlisle homes: Should I sign an incorrect document? 4Feb 03, 2021 6:14 pm The sub contractors who build your house won’t be provided with variation documents afterwards. The plans are what they will work from. Check everything in them carefully at least twice as this is the legal agreement detailing what they will build. Also check every line and word in the contract.
Re: Carlisle homes: Should I sign an incorrect document? 5Feb 03, 2021 7:53 pm I sympathise that the plans included are not the latest copy. Can you ask for a copy of the variation forms to sign at the same time? Our builder was the same level of stubborn and not signing just delayed the build. We ended up signing with an added, formal variation document. I think it is common from my understanding? But it is very frustrating and nerve wracking sometimes! ETA: Sorry, I just reread your post and you said they have now sent through the correct plans. Is that as a formal variation or just an emailed copy?
