Browse Forums Building A New House 1 Jan 27, 2021 12:18 pm Now the builder asking me to pay 2 trucks of extra soil during construction of my house, which is 2520$. And in the contract, it's mentioned that if any extra soil comes up, the owner will be liable to pay for that. But in my case, they didn't inform me about extra soil came during construction. They just send me an invoice to pay it. And they don't have any evidence of extra soil/ pictures. Do I need to pay for it? Please help me out. Just for reference, I had 5 truckloads (65 ton) of clean fill delivered to site before construction for just under $1500. Not sure exactly what soil they are using but obviously a bit more expensive. You are entitled to have some validation, request some specific volumes/weight (required/removed?), why extra, where placed etc. I'd also find out what the extra represented as a percentage of the total required. Where the build required significant earthworks, landscaping etc. and the extra soil is a relatively minor % of the total, probs. be easier understand the variation but if limited earthworks have been done and it is a high percentage of the total it needs to be justified. If the builder has a legit (and supported) reason for the variation which shows that the conditions couldn't have been reasonably expected before the build started it's probably a fair enough claim but it needs to be demonstrated and supported with the details. Examples might be: Builder: We found 600mm of fill in X area which needed to be removed and replaced with imported fill however based on the testing done only 100mm of fill was anticipated. Fair enough. Builder: We found an old line of tress under the lawn, all root affected soil needing replacing to X depth within an area of X. Fair enough. Builder: The site soils compacted well and we got a good base but we needed to add some soil to achieve required levels. Not acceptable-Fill requirements have been underestimated when conditions and requirements are known. Builder: The tall tree in the corner had an extensive root system and the affected soil/roots had to be removed and replaced. Not acceptable-it could have been anticipated that roots would be there. Residential building contracts pretty much stack all the risk back on the client which may be troublesome...
