Browse Forums Building A New House 1 Dec 09, 2020 8:44 pm Hi All, I need some expert advise as I am in a bit of pickle. I have signed in a building contract but builder has delayed the getting permits and engineering and after 5 months asking for 40k more above the contract price for site works as he mentioned this is council requirements for getting the permit this works needs to be done. I contacted another builder who was building the house next to my lot. He mentioned that is very expensive site works and it is not necessary to spend that much and another builder also said the same thing. Now I have decided to end the contract and ask to builder to cancel the contract and return my deposit as I cannot afford to pay that much more. To my surprise he said ok. But he will only return couple of grand as he spend 10k already on soil test and other stuff. Then after chasing him for 2 months he cash deposited to my account around 3k. This all seems to me very shifty stuff. I want to be safe and move on to find another builder and start building. But this builder tactics are scaring me. Re: Changing a builder after building permit 2Dec 10, 2020 7:49 am First_home_builder Welcome to the forum here in Perth A Building Permit is still in effect ( 2 year period), a notice of Cessation BA 8 form is to be submitted to the Council for approval. Include with this application the following; a. A Notice of Completion BA7 from the former builder. b. A list of completed works and uncompleted works. c. A Certificate of Indemnity Insurance β for the works being applied for. Find a new builder then I would also be lodging a complaint in with fair trading as I doubt he has spent that amount on your build. BTW a soil test is about $500, where did the rest of the money go, as you are entitled to a breakdown of costs Also take the matter to the building commission. I will be contacting fair trading as cost breakdown was provided does not make any sense e.g 7k for engineering and preliminaries. We did custom cabinetry and benches in our kitchen and our builder has provided the credits and the new costs as a lump sum. Iv asked for a breakdown and they said they do not provide a breakdown of the costs. As I told him i cannot afford another 40k for the site works as he did not mentioned this to me that site cost would be that much when we are signing the contract.
