Below is the guideline that he has pointed out is highlighted below: Subdivision 32 Rainwater tanks (above ground) 2.63 Specified development The construction or installation of a rainwater tank above ground is development specified for this code if it is not constructed or installed on land in a foreshore area or in an environmentally sensitive area. 2.64 Development standards (iii) be located at least 450mm from each lot boundary, if the tank has a height of more than 1.8m above ground level (existing), and (d) not rest on the footings of an existing building for support, and Our rainwater tank slab is connected to our house slab and is sitting less than 100mm from our boundary. The height of the tank 1900mm. My builder argued that the "ground level (existing)" is defined as the NGL or the level before the earthworks. Since the area where my rainwater tank is now was cut 300mm down, then it is compliant. Is the builder correct? The reasoning sounds silly basing it on the NGL. Moreover, I also argued that I have my rainwater tank slab connected to my house slab - an engineer told me once that it shouldn't have been done like that. They are arguing that “existing” ground level was the basis. Since the site was cut by 300mm, up to 1800 + 300mm will be compliant. The tank is 1900mm + 150mm slab is within the range of what is compliant. This should just be based on finished ground level. I don’t understand why existing ground level was used.
