Certs and final payment

Hi,
Our bank has informed us they will not release final payment to builder until certs of our home have been released by builder.
Builder is refusing to hand over certs since we signed practical completion back on 15th June. They are also refusing to hand us over keys to our home.

They keep sending us reminder payment emails however. It’s so odd, we want to pay them so this contract can end, however concerning why they are not following government policies.

Our bank said the same. We had to supply them with a Form 21 (QLD) occupation permit, we also had certs for our own records provided by the builder. Our builder knew the bank might ask for these and was happy to give the certs over, after all i think you should have them to see its a sound house. If the builder wants their money, you need the certificates. The bank probably wont budge, they need to know its built well.

You could probably also threaten the builder to go legal as theyre not supplying the certs theyre legally required to give. We have QCAT i think for that.

Yes we don’t want the bank to budge. Never heard of a builder wanting to be paid yet won’t send certs. Very concerning
