Browse Forums Building A New House 1 Sep 09, 2020 10:31 pm Hey guys, I am really worried and need your advice. Our builder just gone into liquidation (in Victoria). Builder's company is in external administration now. What do I need to do? Our house is close to finish but not finished yet. Even got subcontractors chasing us up for money since we have chosen our preferred subcontractor. And our house is a new construction not renovation. Any advice would be helpful. Many thanks. Seek legal advice asap Make sure the house is locked up and anything that has not been installed is secure in the premises as sometimes items will now go missing. Hold off any more payments to the builder and make sure you get all your paperwork, invoices and correspondence organised as you will need to have access to this, the more its organised the quicker you can be with solicitor and work out cheaper. If the sub contractors were hired by the builder than they can only chase the builder for money if these works were part of the building contract. If you sourced sub contractors to do works outside of the builders contract than you will be liable to pay them. If you can access the property take photos of everything you can as this will help with evidence of where they are up too. But still want to know some practical aspect of current situation. Wondering what will happen if items go missing? I actually don't know what is onsite. Do you know anything about making claims with DBI? I mean, aren't they suppose to check what the current situation is and then appoint a builder who willing to finish the job? The first part of payment made to builder should have included an insurance payment (the builder also covers a part of it). You would have gotten a letter from the building commission if this insurance was paid. This covers you for events like this. You will have to go through the normal process of claim.
