Browse Forums Building A New House 1 Sep 09, 2020 9:35 pm Hi All, Looking for some advice on next steps as we're stuck between a rock and hard place now... We've been through all the steps in getting to the signed final plan stage not to mention the large amount of time and money already invested into trying to build our dream home so our kids can grow up in. Issue - Our builder and hydraulics engineer have engaged with council in trying design the stormwater system to drain our site (we have a fall of 4m over 40m from front to back with neighbouring properties on each side and back). Council has outright said that only an easement through the neighbour's property will suffice and no other systems are allowed. Problem is that we have already engaged the neighbours and have written refusal letters which were provided to council and they still insist on the easement option. What are my options? Don't really want to take them to court... after all...we will be living next door to them for many years to come. We're doing a KDR in Sydney within the Georges River Council. Cheers, Jacthan Re: Stormwater Help! 2Sep 10, 2020 1:05 pm There are flooding issues in that council area because it is fairly flat but yet has clay soils and not a lot of remaining dirt. The council has spent money to upgrade their stormwater drainage systems recently and it's seen as a serious issue, so I don't think it's a surprise there's a battle, but i am surprised the council is flat out unwilling to entertain alternative solutions. I am guessing there will be significantly increased site runoff after redevelopment? I don't know if it'll help or not but you could try doing a search of council approvals and CDC certificates for blocks similar to yours to find out who has done those stormwater design, and get in touch with those other hydraulic engineers to see if they can help. They will not accept our DA until we impose an easement on our neighbours against their wishes. Have you been able to successfully resolve this matter with council. If so how did you do it? I am in the process of engaging specialist lawyers to assist us. I have discussed this matter with Mark Coure’s office and I understand the Council policy changed mid last year to this hard line approach. Many people are affected like we are. I am considering approaching The Leader and other media. Please let me know your thoughts.
