No building penalties applied as this was originally a NBG house, as they ended up going broke / out of business / taken over or whatever it was we were luckily handed over to a fantastic independant builder who took everything over and built our house within almost 9 months. When you get to the contract signing, you do not sign the contracts with NBG but it is with the local builder allocated to you. So your contract is actually with the local builder. NBG going bust should not have affected you. If the builder that finished off your house, is the builder NGB allocated to you and the one you signed the contract with then they are responsible for paying penalties. The fact that NBG went bust has nothing to do with it. If you are unsure then ring Building Advice and Conciliation Victoria for advice. When I was speaking with BACV they said one of the options is to pay the final payment under dispute so handover can still occur. You can then move into your home but still follow up on the penalties. This is something you could possibly consider. I understand your frustration but I would be ringing BACV so you have all the facts on where you stand and make an informed decision. If you then decide not to follow through then that is fine.
