I find the second sentence first paragraph a little disturbing but maybe that's just me being skeptical after a two year wait. Woss note on the 12th (if it happens by then) is when we will get 14 days to come up with the funds to settle. I am in a similar position where the bank will not issue final confirmation of our loan until we have a dp number from the lti. Happy to meet on site some time this week if it suits you. Fingers toes and everything else crossed. I paid the deposit for a lot in Wattle Ridge which is 13 Curtis Road. We are in Lot 107. Was on the phone to Kieron today to ask on our registration of land. was told that they have lodged to council and waiting for Endevaur Energy to provide the certicificate to Council so council can finalise and provide the final certificate. What he said that is really ringing alarm bells is that our sunset clause expires on the 30th of June and if the registration does not happen by then, vendor can say that they don't want to sell the land to us and cancel the sale. The land price went up by nearly $100K on our lot since May last year. Really worried if the vendor will do such a thing. We are royally screwed if that happens. Sold our current house and now renting it back from the buyer. On the other hand, my house tender price also expires in August and if we don't go to site by August, again i will be hit with a price increase for house built which will be >$10K. Worry after a Worry and the build hasn't even started yet. Hmm interesting time ahead. The thought had entered my head last week that this was a possibility if it goes past sunset date, but hadn't heard it from the agents.. What a worry: hopefully that is not on the cards. Re: the tender increase, we've already had to wear that as we were told land would be ready last July, then sept, then nov, then december etc etc.... The ONE consolation is that land values have gone up! Fingers crossed minimal issues from now on..... Seems to be a serious lack of regulation and consumer protection in this industry...... When we were considering buying unregistered land the developer explained stamp duty is payable mid way between contract exchange & settlement. We exchanged in November last year. We have just found out you are supposed to pay 3 months from exchange otherwise interest is payable. Did everyone else pay stamp duty 3 months from exchange? Does the Office of State Revenue issue a statement or invoice or something similar? Suprised your solicitor did not mention this. We paid ourd within the 3 months our solicitor gave a reminder. We did not get an invoice. Yeah our conveyancer admitted was her error. She thought we had 12 months to pay when land isn't registered at contract exchange. She has offered to absorb the interest penalty in her fees so can't complain. Can you explain more about the discount with six month build start proviso? Via LPI yesterday I discovered the plan is "under requisition" - queried this with our conveyancer - she said it could mean many things, but was going to do some research and see what she could find.. With sunset date around 2 weeks away, we are anxious, especially in light of "NorthKellyvilles" experience as above, with estate across the rd...... Anyone else have any info? I have no info at the moment, left a message with our conveyancer this morning but still waiting to hear back. Will let you know if I hear anything. Re the vendor pulling out of the contract they can only do that if they can prove that they did not deliberately delay settlement. Re our development I can see two time periods where not much happened in the development. #1 was the period between council approval and start of works on site. Approx 6months. #2 was the time the works where completed on site until submission to the LPI. Approx 4 months. I am more than happy to talk to others if the sale does not go through to join a civil action and take these guys on. I have invested to much money with architects builders etc to lose this plot of land now. He said the requisitions are nothing major, just dotting i's etc., and is hoping to have a response back to them today.. fingers crossed!
