We have noticed that the Progress Payment invoices have been sent out earlier than what they should be. The frame, (3 weeks early) we just paid it and didn't say anything. The lock-up I questioned them on it, and just paid it to keep the peace, even though I don't feel it's very fair. But now I'm concerned it may be happening again with the Fixing invoice. The definition in the HIA contract for the Fixing stage says, "As defined in section (40)1 of the Domestic Building Contracts Act 1995 ( which is "when all internal cladding, architraves, skirtings, doors, built-in shelves, baths, basins, troughs, sinks, cabinets and cupboards of a home are fitted and fixed in position.")but excluding: garage doors, baths or spas to single storey homes, built-in shelves to robes, pantry and linen cupboards, and where contracted, marble or granite benchtops, feature sliding robe doors, feature pantry doors, sinks and basins." So where does the tiling fall into? I know the flooring (tiles/carpet/laminate etc) falls into the Lock-Up stage. But what about all the wall tiling? Would that be classed as internal cladding? And what about the toilet? And shower screens/doors, and the kitchen glass splashback? I don't know if i'm just reading too much into it, or are we simply getting charged for stages that are not at all complete? Ie. we have been charged for Lock-Up, which is meant to include "all flooring laid" when we have had no flooring, carpet or tiles, laid whatsoever. So I just don't want to pay another invoice yet again when the stage is not complete. NB. The flooring is still not in, and hasn't even begun! This is what has been done so far - slab, frame, roof tiles, gutters and fascias, all brickwork, render, windows and doors in, plaster hung, skirtings and architraves are fixed, painting just started, kitchen, bathroom, ensuite and laundry cabinets are in, internal doors hung. Still waiting for - all floor tiles and carpet, painting to be completed, bathroom and ensuite basins, showers screens and bath to be installed, kitchen benchtops to go in, all wall tiling, all electrical/lighting switches and fittings to be installed onto plaster walls and celings, shower head/handles, all sink spouts and handles, kitchen glass splashback, panel garage door and remote garage door opener, all door furniture, shelving in all cupboards etc. I may have missed some but it's all I can think of at the moment. So what I really want to know is, out of this list what should fall into the Fixing stage, if any? Should the wall tiles be included? What about the toilets? And what about the light fittings and switches etc? Are these things considered as part of Fixing? Please help!! Even if you don't know exactly how the HIA classes things, can you at least tell me how it was done in your build? Thanks guys. The door lock to the back access door went on 2 days before handover. I do believe that the concrete slab is considered flooring - as in if a house is built on stumps - the flooring isn't laid at the same time and there still access to the house hence it not being "locked up" - hope this helps EDIT: finished post and grammar! By flooring they mean base flooring, in this case it's a slab so it was done at slab stage. Some homes will be on stumps so have different flooring if that makes sense. You don't need tiles to get a certificate of occupancy so you definitely don't need them as part of completion. aldavies3 So where does the tiling fall into? Why would you want your carpet in at lock up stage when there will be painters, sparkies, etc, etc coming into your house to work for the next few months? Carpet and wooden floors (if over the slab) would be the last things you'd want done so they didn't get damaged. Internal cladding means plaster, not tiles. I didn't build with Carlisle, but just because you get your invoice doesn't mean you have to pay it. They send them out according to a time frame that can get off course pretty quickly. When you get your invoice, if the stage isn't finished, ring the accounts department and let them know the stage isn't finished and they should be fine with it. That's what we did with my builder and it wasn't a problem. I leave you to fend for yourself, figure things out yourself. Thank you for pointing out the flooring description properly to me. Of course I'd rather the carpet and tiles not be laid until the end, to avoid being damaged, but I also didn't want to be paying for something that wasn't done. I'm glad to hear that the way things are being done in our build and pretty-much the "norm". Sometimes I'm a bit too sceptical, I think! We actually had the tiler working over the Christmas break, which was good. They have also done the external painting and a few other little things since the Christmas break. But our PCI is booked in for 10th Feb, so maybe that's why they're hurrying things along now!
