I got spoken to about a few things on my site which I have to sort or get fined. So more crap to sort out. Might be an idea to pass this info on to your builders if you want. Stop them dragging dirt down the road. Sounds very silly to me, But as predicated I guess the notices went out as all of the MJH home got done, as they have a guy out there today fixing them all for them. Don't quite understand how they can insist that landscaping be competed prior to occupancy. Hopefully is is just another example of the disconnect between the developer and the council that can be quickly resolved (and in the favour of all of us who have been working to a set of rules since day 1!!) There is absolutely no requirement in the occupancy cert rules that I understand could require landscaping to be completed. However, the matters that would need to be completed before Council would issue an interim occupation certificate include: 1. An operational kitchen 2. An operational bathroom and toilet 3. An operational laundry 4. Smoke detectors installed 5. All walls and ceilings sheeted, windows and doors installed and weatherproofed 6. Electricity, water and sewer all connected The above matters are a minimum. The inspection may raise other matters that might need to be finalised before an interim occupation certificate was issued. The interim occupation certificate allows you to occupy a building while other matters still need to be finished. Matters such as floor coverings, curtains, painting, landscaping etc don’t need to be completed before occupancy however, they would need to be completed prior to a final occupation certificate being issued. Council will issue a letter at that stage listing what would need to be finalised before a final occupation certificate was issued. An interim occupation certificate should satisfy your bank as it is a certificate allowing you to occupy the building." So according to QCC you can get a interim occupation Certificate, move in, then complete you garden and get the full one. I totally agree with everyones comments above as we are paying/mortgages sooner we all move in the better. Hope this helps some of you. We haven't even gotten DA back yet so I was not expecting anything to have happened Pretty weird ruling on the certificates of occupancy though - we are also doing our own landscaping once we've moved in, although with some cooperation from the builder I SUPPOSE we could start on it before we actually take possession, maybe? Apparently QCC is trying to do away with the interim occupancy certificate - hence all the 'other matters' you've mentioned above would all need to be completed in order to get a full occupancy certificate, as thats all they want to provide (efficiency saving maybe??). Our builder is trying to get around it, and there may be issues with QCC changing occupancy rules to ones that are inconsistent with NSW state rules. Here's hoping this gets overturned.
