The Tempo was actually our 2nd choice after the Villina- my wife doesnt like the small living room of the tempo as compared to the quite larger living area that you first walk into with the Villina....otherwise the tempo ticks all the boxes for us. Oh well its good to know that at least on paper we would be able to build the tempo, although I think my wife may need some convincing ..she loves the Villina ( as do I), but i dont want a horribly shrunken version of it !! Making big changes to the Vallina could work out very expensive and end up costing more then the Tempo in the end. Masterton are like a production line and any deviations from he standard will cost more due to the larger variations to he structure etc. Just some food for thought. Sorry I led you up the garden path! It wasn't in Pathway it's in the document "Things to do before you move into your new home". It came with our Progress Claim 5. It says: The installation of the air conditioning, alarm system, TV & phone points, antenna, garage remote and intercom will be completed after settlement as agreed with applicable supplier, if they are included as part of your Building Agreement. I thought that the 5 weeks was part of the 32 week contract! Now i understand why everyone is upset and i am now also! Hoe do we dispute this? Hi Bexi, We've sent a letter to head office disputing their claim for a 5 week extension as per clause 9.3 in our contract 9.3 If the owner wishes to dispute the builders entitlement to an extension of time the owner must, within 5 working days of receiving the notice, give the builder a written notice: (a) disputing the extension of time; and (b) detailing the reasons why the extension of time is disputed. We've pointed out that there were tradies on site up and until Xmas and again the week after New Years, so that in our opinion they can only claim for lost working days in between which is alot less than 5 weeks. If there are people working on site there hasn't been a delay and therefore a delay can not be claimed. Its the same thing as if it was raining outside and the tradies were working inside - they can't claim it as a rain day. They have to get back to us in 10 days with a response. p.s Congrats on the slab!!!! I am very annoyed and will be raising a dispute. My understanding is that the Commencement Date is the date that the first activity happens on site. If this is the case then the first activity was the portaloo dropped off on site last Monday which was 11 January 2010. They weren't even on site on 22 December when they apparently became aware of this delay! I'll go through the contract today and prepare our letter. In which case, I don't think our 20 days are even up. From memory, our discussion with our preconstruction coordinator said that the 20 days starts from the date that you sign the validation letter, and we did that on 24 December. Bexi - Congrats and I'm glad that you made it to construction within your valid tender period. We've got our LOC the other day and the final tender yesterday. But we're not happy about the final tender since there were a lot of mistakes added to it and would cost us around $5,500 in extras. I may have to dispute it as well and I already spoke with council this morning and to get their advise. Unfortunately, we've only got 10 days to go before our tender expires and our CC is not done yet since there are issues with the final tender. Can't believe this is happening to us in the last minute. Btw. Does anyone here had a waterboard sewer pegout added to your tender ($840)? Saying to determinine the precise location and depth of sewer. Thanks!
