If they go bust and they don't have current insurance.., you will most likely get nothing!! The builders indemnity is paid before the builder can get the certificate, and the insurance is still in place for each home as they are all separate policies. Actually thats incorrect, Indemnity Insurance expires at some point and needs to be extended should the builder not be able to complete the house prior to the expiry of the insurance. They need to have insurance prior to getting a Building Permit but if they are going bust, why would they extend the insurance. Its not like they have cared so far. Mine has expired so what happens to me? Do I need to get the cert changed? I'm still insured aren't I? They knew exactly what i was talking about as soon as i mentioned this company. The investigation now has our complaint and i also urge everyone to email enforcement@commerce.wa.gov.au. The more people that get together and speak up the more chances we will get out homes completed! So the people that have emailed this email address... Can you tell me if you had to pay for the official complaint and go through the process (ie proposed complaint to freelife), etc? I did not pay any fee and at this point with the amount of complaints they are receiving, I don’t think we will need to (I could be wrong though) I was told that if I did make a formal complaint by filling out the paper work and paying the fee it might not do me any good seeing as my contract isn’t up yet. I know other people are out of contract so it might help them but it seems as though the ball is definitely rolling in a positive direction so I personally would be apprehensive about paying a fee when in a couple of weeks they might go in to administration, but everyone should do what is right for their own situation. Would be worth reading it in regards to the section "time of performance" have a read and If they go over there is a clause in there that may help in regards to breach of contract. possibly if they serve you with a extension of time.
