If they want legal processes involved, then that is their choice. They have more much more to lose than us in terms in hundreds of millions of dollars and their reputation on this project. If they can't resolve this for the early stages, its going to set them back for all subsequent stages, then they are going to run into cashflow problems if settlement is held back by the courts and/or Fair Trading Tribunal. By then the developer will have the banks literally up their behind. This is before even the media is involved. For your information, Kylie O'Kane (the sales agent) stalks this thread so only write stuff, where she will go and report back to the developers. Let us show to everyone that we are civil about this and refrain from mentioning names in public as we dont want to aggravate matters at this point in time. Let us exhaust all means possible and wait until we receive formal notifications from our builders after we have also formally informed them about the delay (this is notwithstanding that GL may have formally informed them as well). There are matters that we can all discuss privately, somewhere if need be, and not show our aces this early. Please email me if you need clarification. By then we should have a response from our builders. If the outcome is not as expected there are several options, which im sure GL and builders would like to steer away from. I too agree that all should wait for their builder's response. A dispute is a lose-lose situation and should be the last option. I am a bit disappointed with the way the whole issue has been handled by the developer. They tend to forget that they have sold us a H&L package (even though we have signed two contracts) and the builders have been chosen by them. They should have spoken to the builders directly to come up with an amicable solution than asking us to negotiate with the builders. If I am correct, Masterton is the only builder who has treated the contract as a typical H&L contract. Wisdom has covered the gaps in a H&L contract and a House only contract through their good gesture. I sincerely hope the other builders also will follow the same path. This includes approval from different entities such as Council, Endeavour Energy, water works etc. This will take approximately 8 weeks based on how busy they are. Do not know whether DA is applied or still in progress 2> Apply for Land Titles registration that will take another 4 weeks. 3> Settle land contract within 14 days after land registration GL will inform all buyers once DA is approved from council so we can start organising our finance.
