Has anyone else experienced a COVID Clause in their HIA contracts e.g; if the builder can't get materials in, then this can be a cost increase to me as the buyer.
I am building with Sherridon and have been presented with a HIA contract that has a COVID 19 clause in it and I am not agreeing with this clause.
Hi Danyg
While it’s commonly the case that HIA contracts are drafted to protect their builder-members, it is also true that the pandemic did in fact adversely affect the supply of raw materials, and consequently, their price - hence the need for builders to include a COVID clause in their contracts.
However, as we slowly ease back into normalcy, COVID clauses such as the one in your HIA deserve a second glance and a more thorough consideration . A prudent move would be to submit your contract to Contract Review and Advice from a specialist construction lawyer in your area - who can help you negotiate the terms of the clause with your builder.
Cheers
