what are my legals rights in getting fix or is it just bad luck and I have to fix it myself.

Probably nothing you can do but you can buy insulation in bags and install it yourself. It doesn't cost all that much. I bought 2 units and 1 house that had no insulation and I did those myself, it didn't take long. Stay away from fiberglass products if you do it yourself though and don't cover any light fixtures (or fans). Good luck.
