Hi everybody,
Does anyone have any advise for us?

Re: Frustrated with Masterton 2Jul 06, 2016 9:00 pm I am so sorry for the issues you have faced have you tried making a claim through home building compensation insurance. I am not exactly sure what this insurance is however we have just been provided details as we are nearing the end of a very long stressful Masterton build. Unfortunately I think Masterton have changed and are leaving a long list of very unhappy customers. Have you tried going to the top David Masterton, leaving a review on product review, or Fair Trading would be able to help I am sure. Fair trade told us there is little they can do. We were suggested tribunal but the insane amount of legal work we have to do ourselves is borderline Erin Brockovich levels of time and dedication for an uncertain outcome, and with.2 children under 2 it's tough. Our solicitor suggested a letter of demand($1000) but advised Masterton is under no obligation to respond. We are really upset. Dealt directly with Clint Masterton who was a total clown. It's disgusting. I'll forever advise no one deal with these crooks. Doesnt sound like much, but it was enough to have council demand we board up windows on that side (due to fire issues) and the side is too tight to fit lawnmower or garbage bins down that side. We cannot use the other side as we choose to put the water tank on that side - rendering it impassable. Re: Frustrated with Masterton 9Jul 07, 2016 2:40 pm This may or may not help you but there have been numerous slabs mentioned on this forum that have either being the wrong height or position, your situation is not unique. Have you tried a forum search using a combination of key words like slab, wrong, position, etc? You would also be better off re-titling the thread and having it transferred to the Building Standards; Getting It Right! sub forum so that the 'resident' industry experts will see it, posting in the New Home sub forum is not a good move for a topic like this. Why don't you move the water tank? Maybe get a small Thin Tank to replace it and collect the water and then run a balance line to the original tank. Is this feasible in the interim? http://www.bing.com/images/search?q=thi ... &FORM=IGRE http://www.thintanks.net.au/about/ 3in1 Supadiverta. Re: Frustrated with Masterton 10Jul 07, 2016 7:06 pm Have you tried contacting the mater builders association? http://www.masterbuilders.com.au Or Housing industry association. Am surprised department of fair training wasn't able to help as your contract with the builder was broken by placement of the house in the wrong location . You could also lodge a complaint using the below link http://www.complaintline.com.au/builder.html Re: Frustrated with Masterton 11Jul 07, 2016 7:33 pm Tom2016 Have you tried contacting the mater builders association? http://www.masterbuilders.com.au Or Housing industry association. They are trying to bully you and protect their reputation. I think good legal advice is in order. I am honestly surprised about how unreasonable council are being. Out of curiosity do your neighbours have a problem with your existing window locations or is that simply council? I would have thought there was an appeal process. I'm afraid I don't know anything about that though. I wish you all the very best C U S T O M. C O R A L. I feel for you.. sorry to hear about this.. but this is what I will do: Firstly check if the surveyor is registered, if he is registered, he is clearly incompetent and should not be allowed to practice anymore. I will lodge a complaint against this surveyor with the board of surveyors. e.g. http://www.bossi.nsw.gov.au/ Secondly, you have already gone to the fair trading for advice that is good. Since the house is already built nothing much can be done but you can come up with a list of outcomes and what you want to achieve and get a tribunal order so that your builder can comply. Eg. Builder to pay: for surveyor fee for fence relocation at their expense for water tank relocation at their expense etc.. It may seem a lot of work to do but in order to achieve the outcome you have to push on ..else.. the builder won't care... good luck Re: Frustrated with Masterton 14Jul 08, 2016 10:49 am hi all, thanks for the advice. We have calculated we are missing roughly $3000 worth of land )based on 2014 prices), we wonder what the value of this land will be in 20 years when we decided to sell and move??? A lot i would imagine.... Re: Frustrated with Masterton 15Jul 08, 2016 12:31 pm The poor siting, changes to the house and the lack of backyard access is where your monetary losses are and not the value of the strip of land that you never owned anyway. Combined with your current and future out of pocket expenses, your loss is substantially more than $3,000. The problem is that builders know the law and they also know that a new home buyer rarely has the disposable income to explore their legal options. 3in1 Supadiverta.
