My builder didn't put any retaining walls on my DA plans but I clearly need them. In my estate it is a requirement to have lapped and capped timber fencing so the common thing is to do the normal fence with pine sleepers underneath it. 1) My neighbour on one side is a builder and his brother is a fencer. He cut his block 800mm to get his driveway lower whereas my block was a 400mm cut and fill back to front. He has already done the fence and hit me up for half which I wasn't too pleased about since he had a massive cut but according to the Dividing Fences Act sleepers under a fence aren't technically a retaining wall and are considered to be support for the fence (http://www.austlii.edu.au/au/legis/nsw/ ... 37/s3.html). This means I needed to pay 50% of the total. Is that true? I paid it because I didn't want the confrontation and he seemed to know what he was talking about. I've also just now looked at the NSW SEPP and under Section 29 (5) (http://www.legislation.nsw.gov.au/#/vie ... /572/whole#%2Fpart3%2Fdiv2%2Fsubdiv6%2Fcl3.29) it states any wall over 600mm located on the boundary needs to be designed by an engineer. It's easier than trying to interpret the full DA regulations.
