The builder will be meeting with the neighbours in a few days. Obviously if the neighbours don't agree the house will be rebuilt. I would explore again the option of builder buying you out. I have been successful in getting one of my clients bought out of a problem home in QLD. You hold all the cards - the builder did not meet the spec, so its 100% his responsibility. At worst he has to totally rebuild, least worst he could buy the block from you. The latter option would be far more preferable to the builder than the former option. Dont allow yourself to be sold short on this. The builder stuffed up even though his licensing ostensibly declares that it should not happen. It is fair that the builder pays a substantial penalty whatever the outcome, since this is a very stupid mistake on its part. Be really careful to agree just because they are being nice. Of course they are playing nice, they don't want you to force a rebuild. Also, why are you even discussing a reduction in final payment? Surely that is only 10% of the total build cost. I don't know the cost of your build or the total value of your finished product but 10% off seems like the absolute least they should be offering.... Plus the other stuff you have mentioned. I, personally, don't think you should be spending one more cent. This survey was never booked or conducted, however we were charged for it. Could you share what was the outcome of the builder's meeting with the neighbours? Were you allowed also to attend? Also, is there a standard deviation tolerance that the council would allow as a reasonable error? House must be built as per the plans unless you approve a variation. So the ground floor and first floor is 1500mm from the boundary in lieu of 1800?? What stage are u up too, was it pegged out wrong and are you happy for it to remain?
