I've had a house built and the rear of the slab comes within 40cm of a stormwater easement, however sits approx 90cm higher than the easement level. The builder simply banked up dirt against the back of the house to support the slab (See photo). The red marker shows the easement and you can clearly see the dirt built up behind the marker. Now the council is telling me that NO earth can overlap the easement, and the banked dirt must be removed - however this will cause slip from under the slab. Building a retaining wall will require approvals, exemptions and dollars as it's within 1.5m of a construction. So the question is - is this just bad luck for me, or should the builder bear some responsibility? What should I do moving forward? I should note - the photo was taken during construction.
