About 15 year's ago, had similar situation, got on side with engineer and won vcat due to builder not following engineering, house stopped moving and was repaired really well by insurance , would be easier chasing repairs, keep in mind the year's of stress and that either way you will have to accept the outcome . Re: VCAT - experiences with significant foundation problems 23Dec 21, 2016 3:44 pm Get alaw firm to draft your application and label attachments to open a case at VCAT, you can object to builder using legal rep in tribunal and represent yourself. VCAT was created so everyday people have access to justice and the members will be supportive and offer guidance. Good luck. Re: VCAT - experiences with significant foundation problems 25Jul 31, 2017 2:38 pm Sorry, I only just noticed your update now Joker when searching for something else! Re: VCAT - experiences with significant foundation problems 27Jan 15, 2018 10:56 am We finally got a case manager and had to provide the documentation we had and a list of defects. The builder had until mid December to reply to each one and a conciliation date is booked for later this month. It's been a lengthy process with the DBDRV just to get to this point! Re: VCAT - experiences with significant foundation problems 28Jan 15, 2018 11:47 am Some good news t parsons, hang in there, got to say, since councils don't handle all aspects of building, quality control has dived, so much time goes by in these situations, I've seen some go 6_7 years after problems first got reported, this alone is a huge chunk of a families life almost destroyed.
