We have the drain cover and understand we can't build near it in an area about 1.5 sqm. But we will probably have to build a retaining wall along the back of the property to a height of approx 900 high. Our builder said it will need to be a minimum of 1.5m from the back fence, giving us a fairly useless strip between the retaining wall and the back fence. My husband has come up with the ingenious idea (one of those 3am epithanies) to build decking over the gap with a hatch to gain access underneath giving a covered storage area for kayaks etc. What I would like to know is can we build that decking over the the easement as long as we have that segment on hinges so it can be lifted up and accessed if need be? It's where the the bottom of the footing, if you draw a line 45degrees downward from the base must not be in the range of an easement. This is so that the pressure the footing imposes on the soil does not push force upon the easement pipe. Unfortunately it's a messy situation where you have easements involved. You could avoid this situation is you didn't dig any holes and instead used concrete feet that you can buy from Bunnings that might get you around permits etc. Maybe... Build what you like as long as it can be removed easily if the easement owner ever requires access. Bear in mind it may never happen unless the drain gets clogged. As Adam.M says, make sure what you build does not adversely affect the drain's integrity, else you will be financially liable to repair it. Hi, as per the subject.
