House will be set back from road approximately 5 or 6 metres, then on the other side of the road there is a 2 or 3 metre rain garden on the kerb, followed by another 5 or 6 metre setback for that house facing the road also with the road itself being around 17m due to it being 2 lane plus parking lane. I couldn't locate the overlook law for NSW directly but VIC one says "within 9m" for clearance of overlook.. and that would be much greater than 9m.. well over twice that distance. Ed Haha.. good point, didn't think of that. He's contesting it through Clarendon Homes. He did have to reduce some side windows already, which was reasonable as they did overlook. I think whoever was manning the desk that day saw the word "balcony" and without considering the shape, size, shape and all four walls, immediately marked it as needing a privacy screen. Will see what happens.
