Browse Forums Building Standards; Getting It Right! 1 Jul 21, 2013 5:02 pm Hi All, I am new to your forum so hope someone can help. We have been living in our home for almost a year and our neighbours who have just build and moved in are constructing a very large shed approximately 10cm from our side boundary. It appears to be about 9 mt long by 4 mt wide and about 3 mt high. This shed has omitted all light from one of our bedrooms and takes up 3/4 of the window in the remaining bedroom. These rooms are west facing. I always thought that a building of that size needed to be at least 1 mt from the boundary. I have looked up the building commission of Victoria and all I gain from that is that they require a permit. So my thinking is that we have no say in the situation even though it has devalued our property. Anyone know anything about this and what we should/can do? TIA. Re: Help with neighbour building a XL shed 2Jul 21, 2013 6:17 pm Every area and zone is different. Have a chat to your local council building/development department. Without knowing every aspect of your situation, I can say there is a very good chance that this has been assesed and complies. Assuming this shed is constructed of steel/non combustible material it can gain exemptions from the 900mm boundry setback as detailed in the Building code. There would also have to be no window on this side. Sorry to say it, but there is a good chance it complies, but have a chat to your council as I dont know your exact situation or zoning rules Re: Help with neighbour building a XL shed 4Jul 23, 2013 7:48 pm Look at the new draft planning laws they are proposing in Brisbane: Quote: BRISBANE residents hoping to build sheds or granny flats may have to love thy neighbour and hope the feeling is mutual if the draft new plan is adopted in its current form. Proposed regulations for residential blocks smaller than 400sq m will require written consent from neighbours before building can begin within 1.5 metres of the property boundary. http://www.news.com.au/realestate/news/new-draft-of-city-plan-will-trigger-more-planning-applications-claims-housing-institute-of-australia/story-fndbalka-1226683199109 Build thread: here Land Nov 12, Contract 6/07/13, Consent 15/08/13, Start 20/09/13, Slab 25/09/13, Frame 4/10/13, Brick 21/10/13, Roof 2/11/13, Lock-up 17/12/13, Handover 3/3/14 Re: Help with neighbour building a XL shed 5Jul 23, 2013 9:32 pm I thought that's what the law was already! What is the situation now?? And why do they specify under 400sqm? What about properties over that size, are they allowed to build closer to the boundary or something? :s Build thread: viewtopic.php?f=31&t=65085 Re: Help with neighbour building a XL shed 6Jul 23, 2013 9:42 pm damson I always thought that a building of that size needed to be at least 1 mt from the boundary. Yeah, I would of thought so. I know councils differ but I'm not in Victoria and theres rules like that here too. I thought something like that is fairly standard. When we built our old house we had to get agreement from our neighbour and his house was way back from that boundary but we still had to seek his okay. Re: Help with neighbour building a XL shed 7Jul 25, 2013 10:03 pm Here in QLD neighbours arent consulted, it is all assesed against the building code which clearly sets out building setbacks. Some areas and covenants have slightly tougher setback rules on top of the BCA. In a way its not fair if your neighbour gets the final word. what if they are a stale, grumpy old so and so and just didnt want any change to be spitefull? Remember, we all dont live in the suburb depicted on chanel 10 about people that live next to each other........forget what its called.... Re: Help with neighbour building a XL shed 8Jul 26, 2013 12:12 pm A wall on a boundary (vic) needs to be fire rated & a max. length of 10m plus 25% of the remaining length of the boundary. There are a few other proviso's including shadowing of neighbours north facing windows etc. Peter Clarkson - AusDesign Australia www.ausdesign.com.au This information is intended to provide general information only.
