The only way You'll be allowed to build right up to the foothpath is if there was an existing structure built like that. Even then if you pull down that existing structure the chances are you will be forced by council to obide by new offsets. Nothing can overhang on any boundary. If your building on the boundary in most cases there will be no eaves rather a parapet wall with internal box gutter. In this case would that 2m be to the wall, or to the gutter/eaves? Same case for the neighbour boundary, at a setback of 1m from the neighbour boundary we can build a wall 3.6m tall. Would that usually be to the top of the wall, or the top of any part of the structure (i.e to the top of the roof) at 1m setback? Not quiet following what your second question is but in all cases your offsets are from the wall, not roof line. (Standard A3 - Planning Provision 54.03). With your side / rear setbacks to your neighbour you are correct regarding the 1m setback for 3.6m height (typically), however Sunblinds, verandahs, porches, eaves, fascias, gutters, masonry chimneys, flues, pipes, domestic fuel or water tanks, and heating or cooling equipment or other services may encroach not more than 0.5 metres into this offset. Landings having an area of not more than 2 square metres and less than 1 metre high, stairways, ramps, pergolas, shade sails and carports may encroach into this setback.
