Browse Forums Building Standards; Getting It Right! 1 Apr 30, 2013 12:56 pm Hi all, My wife and I bought a brand new townhouse from a builder last year. We were and are still new to building stuff. We are seeking some advice for situations below. After 2 months we moved in, we found Air-Con put in by the vendor didn't work. Surprisingly, there was no warranty paper what so ever anywhere. Then we started contacting the vendor. However, the vendor's number is in busy mode 24/7. So, I started asking neighbors and eventually realized the vendor went oversea. So, instead of waiting to get some result from the vendor, I called a Air-Con guy to fix the problem for me. The nice guy admitted to me that the Air-Con wasn't commissioned at all and wrote this down in the receipt paper, in case I might need to chase the vendor up for reimbursement. Secondly, 3 months later, we had our Oven played up. Same story, we paid someone to fix it up and keep the receipt to the hope we could find the vendor. If the above issues are minor, then this one starts getting me really worried and upset. We started hearing noisy come from our first floor and my neighbor's when they walking on their floor. Some of them are steps impact sound and the others are squeaky sound. I was woken up by neighbors walking on first floor subconsciously from time to time. It is not just the sound but also vibration as well. This makes very uncomfortable and annoyed. These townhouse were built and finished in Jan 2012 and sold to us at August 2012. I am not sure if this could be a problem of the building structure or not. We do have Strata here manages shared drive way, but not sure if this issue can be raised to them or to Building Commission Victoria since the vendor builder can't be reached at all . The basic rules are, "if the builder becomes insolvent, dies or disappears, you might have a claim to chase with the insurer for defects". Contacting the Building Commission Vic is exactly what you need to do. That should even have the details of your build considering the builder would first have to register with them. Maybe you need to employ a private building surveyor. Once you have determined whats causing the issues and if you cant get in contact with the builder then I would contact the building commision.
