But if the 125mm includes anything that would not withstand human impact (overhang) - I am testing some balustrade at this moment for exactly this - then the system does not meet the standard and needs to be fixed. If it was me... if it is tile overhang that brings it within 125mm, then tell the builder it needs fixing. If it is within 125mm then I would fit a box section of aluminium in anodised to the balustrade to cover the gap. The overhang certainly increases the gap between balustrade and slab to >125mm however not including the overhang, surely if my foot can easily fit down that gap (and also a toddlers body), surely this isn't safe or fit for purpose??? I've notified the building conveyor, building commission and local council just so that my concerns are documented. It's now up to the developer and builder to work out if they will fix it or take the chance.
